First in a series of analysis of the federal cruise ship decision BAR HARBOR, March, 3, 2024 - The Association to Protect and Preserve Local Livelihood may continue to rattle its saber and prolong the pain of litigation to slow the inevitable, but the Town Council faces quite a different choice in the matter of cruise ship visitation.
Judge Walker's ruling can be read on Bar Harbor's website. Sixty one pages sounds intimidating but if you think of it as short story, the judge's writing is lively, entertaining throughout and in parts one can imagine him shaking his head in disbelief and just barely refraining from ridicule because most of AAPPL's arguments are so off the wall he needed to remind himself a modicum of judicial gravitas was appropriate. AAPPL (oops OPL) should demand a refund. One assumes they hired a high priced law firm yet the issues they advanced to support their clients held as much water as the Titanic. I have great respect for the legal profession, the attorneys I've used over my lifetime were chosen with care and been sensitive to all the issues involved without compromising a dedicated advocacy on my behalf. That said, I mean no disrespect in mentioning that AAPPL/OPL probably could have saved themselves a ton of money and either called the 2's or the law offices of Joe Bornstein. I'm thrilled they didn't. This outcome was perfect.
Perhaps APPL believed the previous Town Council, their pet Town Manager Kevin Sutherland, and the town lawyer serving their cruise ship boosterism position that a case against the town could prevail. That, along with the notion that the courts generally favor the big guys over the little guys.
They just didn't count on the remarkable Charles Sidman and a fair judge.

The voters have spoken and the courts ruled. Lets enforce the new cap and punish anybody or any business that works against the cap. This is for the preservation of the environment and the quality of life in Bar Harbor.

As with other of his significant rulings (take that Bruce Poliquin and his self perjuring expert witness) Judge Walker is nothing if not thorough in articulating his legal opinions. And if he gets me to look up 'conclusory' and Mr. Herbert Spencer's 'Social Statics' - so much the better
Here is one more reason to be biased against cruise ships.
Canada stopped the Cruise ships from wantonly killing over 18 Right Whales by closing the SW corner of the Gulf off St Lawrence to Cruise Ships. They were killing an average of 6 RW per year. Now 4 years have gone by and not one whale has died. 24 whales have been saved. Cruise ships are the enemy of all things natural.
